International Trade Commision United States, has decided that Android smartphone manufacturers, HTC has violated two patents of Apple.

Based on Apple’s claims, the patent which infringed by HTC are:

1. Apple’s U.S. Patent number 5,946,647 about system and method to perform an action on data structures in computer-generated.
2. Apple’s U.S. Patent number 6,343,263 about signal-processing system for real-time data transmitted and being serialized.

This ITC decision also the first court decision which found that Android in violation intellectual property rights of third parties.This potentially has huge implications on HTC business inUnited States and potential negative impact for the whole Android platform.

This punishment could lead to ban the sale of HTC products in theU.S.if HTC can not find way to work outside the disputed intellectual property. HTC can seek settlement from Apple, if Apple is willing to grant the license. It will force HTC to pay more royalties for using Android smartphone.

According to Florian Mueller patent rights observers, Apple unlikely to give license to HTC for these patents, and they also will be make a claims that would more strike this Taiwanese company. Although HTC claimed that they had found the ’alternative solution’ for this patent case, Mueller is not very optimistic look at that.
